Apostille in Ukraine

Legalization of a document is required almost always when this document is intended for official use in another country, with the exception of the following cases:

• an institution where a document is intended for use does not require its legalization;
• when Ukraine and the country where a document will be used have a bilateral treaty on abolition of legalization requirement;
• when a document cannot be legalized because of its type, form, or meaning.

According to the Hague Convention of 5 October 1961, an apostille affixed to a document intended for use in a country which is a signatory party to this Convention is sufficient for this document to be recognizable by that country’s legal system.

An apostille is affixed to official documents to certify authenticity of signature of an official who signed this document and authenticity of seal affixed thereto. An apostille may be affixed to a document itself or to a separate sheet duly affixed to this document. It has square shape with the sides at least 9 cm. The title APOSTILLE (Convention de la Haye du 5 octobre 1961) must be in French, and the text of the stamp itself is written in Ukrainian. The Hague Convention does not allow to make any changes in the text of apostille or change the order of lines in the stamp. Apostille cannot be made by photocopying the stamp or by some other method and then attached to the apostilled documents. In all cases an imprint of the apostille stamp must be affixed to a document.

A duly procured apostille does not require additional certification. Every signatory state of the Hague Convention has right to choose the agencies authorized to do apostilling. In Ukraine, documents may be apostilled by the Ministry of Justice, the Ministry of Foreign Affairs, and the Ministry of Education.
